A Guardian ad Litem's recommendation can change your child's life forever. But did you know that in Washington State, there are strict legal "minimums" for how that investigation must be conducted? If your GAL hasn't observed your child in your home, they may be in violation of state law.

The Household Observation

Under RCW 26.12.175, a GAL is generally expected to observe the child in each parent's household. This isn't just a suggestion; it is the foundation of a "thorough" investigation. A GAL who issues a recommendation without setting foot in both homes has failed to meet the most basic standard of care.

The "Expert" Limitation

Parents must understand that unless a GAL is also a licensed medical doctor or psychologist, they are legally prohibited from issuing clinical diagnoses. If your GAL uses terms like "Parental Alienation Syndrome" or "Borderline Personality" without a medical license, they are overstepping their statutory authority.

A GAL is an investigator and advocate for the child — not a clinician. If clinical language appears in their report, demand to see the medical credential that authorizes it.

The Interview Requirement

A proper investigation requires the GAL to interview both parents and any relevant "collateral" witnesses — teachers, doctors, therapists, and other individuals with direct knowledge of the child's wellbeing. If your GAL is only talking to one side, the investigation is compromised and the resulting recommendation is unreliable.

The 48-Hour GAL Audit

Within the first 48 hours of a GAL appointment, every parent should verify the following:

  • ✅ Training Certificate: Has the GAL provided their 2025–2026 AOC-approved Training Certificate?
  • ✅ Home Observations: Has the GAL scheduled observations in BOTH parental homes?
  • ✅ Collateral Contacts: Has the GAL provided a list of all collateral contacts they intend to interview?
  • ✅ Registry Status: Is the GAL on the official County Registry? Verify on our directory.
